Sound Kitchen Coaching
Terms and Conditions

These Terms and Conditions apply to Sound Kitchen Coaching provided by Michael Chillingworth, sole trader, trading as Sound First Music and The Sound Kitchen ("we", "us", "our").
By purchasing Sound Kitchen Coaching, you ("you", "your", "the client") agree to these Terms and Conditions.

2. About Sound Kitchen Coaching
Sound Kitchen Coaching is a three-month personalised online coaching programme designed to help musicians develop their jazz improvisation through individual guidance, structured practice and personalised resources.
The programme is built around your individual playing, goals, experience and areas for development.
Sound Kitchen Coaching is an educational coaching service. While we will provide professional guidance, support and resources, we cannot guarantee a specific musical outcome, performance result or professional achievement.
3. What is included
Sound Kitchen Coaching includes:
Initial assessment and roadmap session
One 90-minute session where we will:
discuss your current playing
identify areas for development
clarify your musical goals
establish priorities
create a personalised direction for your work together
Individual coaching sessions
Six 60-minute one-to-one coaching sessions.
These sessions may include:
reviewing progress
addressing challenges
developing your improvisation
refining your practice approach
adjusting your personalised plan where appropriate
Personalised resources
Where appropriate, you may receive resources created or selected around your individual development, including:
exercises
backing tracks
PDFs
practice materials
listening recommendations
tune-specific resources
Between-session support
During the programme, you may send questions, recordings or videos relating to your work.
Feedback and guidance may be provided through email, WhatsApp or other agreed communication platforms.
Session recordings
Coaching sessions may be recorded and made available to you for personal review.
4. Programme duration
The programme lasts approximately three months.
Your programme start date will normally be agreed before or shortly after purchase and will begin with your initial assessment and roadmap session.
The programme has a defined beginning and end date.
Any unused coaching sessions must normally be completed within the programme period unless otherwise agreed.
5. Coaching sessions and scheduling
Sessions will normally take place online using Zoom or another agreed platform.
Session times will be arranged by mutual agreement.
If you need to reschedule a session, please provide at least 48 hours' notice where possible.
Where less notice is provided, the session may be counted as used unless there are exceptional circumstances.
We understand that unexpected situations occur and will consider genuine circumstances reasonably.
If we need to reschedule a session, we will provide reasonable notice and arrange an alternative time.
6. Between-session support
Between-session support is an important part of Sound Kitchen Coaching.
It is intended to help you:
ask questions relating to your programme
receive feedback on recordings or videos
clarify ideas from coaching sessions
continue progressing between sessions
Feedback and guidance may be provided through email, WhatsApp or other agreed communication platforms.
Responses will normally be provided within two working days.
Between-session support is intended to provide focused guidance and feedback as you apply the programme. It is not intended to replace scheduled coaching sessions or provide unlimited on-demand tuition.
If the level or frequency of requests becomes inconsistent with the intended structure of the programme, we may discuss appropriate boundaries with you.
7. Digital platforms and delivery
Resources and recordings will normally be provided through Google Drive or another appropriate digital platform.
We may make reasonable changes to the platforms used for delivering resources or communication where necessary.
Any such changes will not materially reduce the service provided and we will inform you where appropriate.
8. Payment
The total investment for Sound Kitchen Coaching is:
$1,500 USD
Payment may be made:
in full before the programme begins; or
through an agreed instalment plan of three payments of $500 USD
Where an instalment plan is selected, you agree to pay the full programme fee through the agreed instalments.
An instalment plan is a payment arrangement for the full programme fee. It is not a monthly subscription that can be cancelled at any time.
If payments are not made when due, we reserve the right to pause coaching and access to programme resources until payments are brought up to date.
9. Cancellation rights
If you purchase Sound Kitchen Coaching online, you may have cancellation rights under applicable consumer protection law.
For UK consumers, this will generally include a 14-day cancellation period for distance contracts.
If you request that the programme begins before the end of this cancellation period, you acknowledge that delivery of the service may begin during this period.
Where services have already been provided before you cancel, your cancellation rights may be affected to the extent permitted by law.
Nothing in these Terms affects your statutory consumer rights.
10. Sound Kitchen Coaching guarantee
We want you to feel confident that Sound Kitchen Coaching is the right programme for you.
After your initial assessment and first month of coaching, if you do not feel that we have identified the right goals for your playing and given you a clear direction for your practice, you may request a full refund.

11. Your responsibilities
To get the most from Sound Kitchen Coaching, you agree to:
attend agreed coaching sessions
engage with the learning process
communicate honestly about your goals and challenges
complete practice activities where appropriate
provide information reasonably needed to support your development
Progress depends on many factors, including your engagement, practice time, previous experience and individual circumstances.
12. Educational outcomes
Sound Kitchen Coaching provides education, guidance and support.
We will use our professional experience to help you identify areas for improvement and develop your musicianship.
However, we cannot guarantee:
a specific level of improvement
professional success
performance opportunities
auditions, jobs or career outcomes
any particular musical result
13. Personalised resources and intellectual property
Resources provided as part of Sound Kitchen Coaching remain the intellectual property of Michael Chillingworth / Sound First Music.
You may use these materials for your own personal musical development.
You must not:
sell the materials
share them publicly
distribute them to others
upload them online
use them commercially
You must also comply with any applicable restrictions relating to third-party materials provided as part of the programme.
14. Session recordings
Coaching sessions may be recorded so that you can revisit them during and after the programme.
Recordings are provided for your personal educational use only.
You must not:
publish recordings
distribute recordings
share recordings publicly
We will not use recordings containing you or your playing publicly without your permission.
Recordings will be stored securely and retained only for as long as reasonably necessary to provide the programme and associated support.
15. Testimonials and feedback
We may ask clients for feedback about their experience with Sound Kitchen Coaching.
Providing feedback or a testimonial is entirely optional.
We will only use identifiable testimonials or feedback publicly with your permission.
We may use genuinely anonymised information about general programme outcomes for educational or marketing purposes where you cannot reasonably be identified.
16. Privacy and confidentiality
We will handle your personal information in accordance with our Privacy Policy and applicable data protection legislation.

Information shared during coaching sessions will be treated confidentially, except where disclosure is required by law.
You agree not to share confidential information relating to the programme or other clients.
17. Limitation of liability
Nothing in these Terms limits or excludes any liability that cannot legally be limited or excluded, including liability for:
death or personal injury caused by negligence
fraud or fraudulent misrepresentation
any other liability that cannot legally be excluded
Subject to this, we will not be liable for:
outcomes that depend on your own practice, engagement or circumstances
loss of opportunities, income or professional outcomes
indirect or consequential losses
Our total liability arising from the provision of Sound Kitchen Coaching will not exceed the amount paid by you for the programme.
18. Respectful communication and termination
We are committed to providing a professional and supportive learning environment.
We reserve the right to suspend or terminate access to Sound Kitchen Coaching where there is:
abusive behaviour
harassment
threatening communication
serious breach of these Terms
persistent failure to make agreed payments
Any decision to terminate access will be considered reasonably and fairly.
Where termination occurs because of your breach of these Terms, this does not affect our right to recover any outstanding payments due under the agreement.
19. Events outside our control
We will not be responsible for delays or failures in providing the programme where these result from circumstances outside our reasonable control.
This may include:
serious illness
technical failures
internet outages
failures of third-party platforms
other circumstances that could not reasonably have been prevented
Where such circumstances occur, we will make reasonable efforts to minimise disruption and continue providing the programme where possible.
20. Changes to the programme
We may make reasonable adjustments to the programme structure, delivery platforms or methods where necessary.
Any changes will be made with the intention of maintaining or improving the quality of the service.
21. International customers
Sound Kitchen Coaching is provided by a UK-based business and is available to customers internationally.
Payment providers may apply currency conversion rates or charges where applicable.
Any mandatory consumer protections that apply to you in your location are not excluded by these Terms.
22. Governing law
These Terms are governed by the laws of England and Wales.
However, if you are a consumer, this does not affect any mandatory protections you may have under the laws of your country of residence.
